Practitioner Membership is a licence to practise the discipline. It does not transfer ownership of the intellectual property.

Nothing in these Terms prevents practitioners from applying the principles of the discipline within their own professional work. These restrictions apply only to the reproduction, redistribution or commercial repackaging of the discipline itself.

Use of the Thisness Name

"Thisness" is the name of the discipline developed by Rob Hotchkiss. It includes the Thisness Method, Lenses, Toolkit, Practitioner Membership and related resources.

Use of the name Thisness in connection with commercial frameworks, training, consulting services, or published materials may not imply authorship, ownership, or endorsement without permission.

If referencing the Thisness approach publicly, appropriate attribution should be given.

Digital Products

This website may link to digital products and memberships, including the Thisness Toolkit and Practitioner Membership, which are sold through Lemon Squeezy.

Lemon Squeezy acts as Merchant of Record for these transactions.

When purchasing a product or membership:

• the transaction is processed by Lemon Squeezy

• payment information is handled securely by Lemon Squeezy

• applicable taxes are calculated and collected by Lemon Squeezy

• delivery and subscription management are provided through Lemon Squeezy

Lemon Squeezy's own terms and policies also apply to the purchase transaction.

Practitioner Membership and Renewal

Practitioner Membership is provided as an annual subscription and includes a personal licence to practise the Thisness discipline together with access to the practitioner resources included with the relevant membership.

Unless cancelled, Practitioner Membership renews automatically each year and the applicable annual membership fee will be charged through Lemon Squeezy.

You may cancel your membership at any time before its next renewal. Cancellation prevents the subscription from renewing and does not end the current paid membership period early.

Your Practitioner Membership and associated licence remain active until the end of the period for which you have paid.

When your membership expires, your active licence ends. You may no longer describe yourself as a Thisness Practitioner, use the Thisness Practitioner identity assets, or use the Thisness name to describe or promote your professional methodology, process or services.

The knowledge, experience and judgement you have developed through practising Thisness remain yours to carry into your work. The end of your membership does not prevent you from applying what you have learned within your professional practice, provided you do not present that work or process as Thisness or reproduce, redistribute or commercialise the Thisness discipline itself.

Founding Practitioner Membership is available for a limited founding period. Practitioners who join at the Founding Practitioner rate may retain that annual rate for as long as their membership remains continuously active.

Licence to Practise the Thisness Discipline

Practitioner Membership includes a personal, non-exclusive, non-transferable licence to apply the Thisness Method™ within your own professional work.

This licence allows you to:

• use the Thisness thinking and tools when working on creative or brand projects

• apply the methodology within your own client work or internal projects

• reference the Thisness approach within your professional practice

• use the knowledge and principles developed through practising Thisness in your own work

This licence does not permit:

• redistribution or sharing of the Toolkit, Practice Sheets or other practitioner files

• resale or repackaging of the Toolkit or other Thisness resources

• publication of Toolkit content in full or substantial part

• reproduction or publication of the discipline as your own framework

• creation of derivative toolkits, frameworks or training materials based substantially on the Thisness methodology

• teaching, licensing or distributing Thisness as a standalone system without permission

• reproduction of Thisness diagrams, frameworks or written structures in full or substantial part

Each membership provides a licence for individual use by the named practitioner.

The Thisness discipline, including its structure, organisation, named concepts, frameworks, diagrams and written explanations, remains the intellectual property of Rob Hotchkiss / Thisness.

The licence grants permission to practise the methodology but does not create any partnership, agency, employment, certification or endorsement relationship between Thisness and the practitioner.

Practitioner Identity

Active practitioners may use the official Thisness Practitioner identity assets supplied with their membership to indicate their practitioner status.

Founding Practitioners may use the official Founding Practitioner identity assets supplied with their membership while their Founding Practitioner Membership remains active.

Practitioner identity assets:

• remain the intellectual property of Rob Hotchkiss / Thisness

• may not be altered, redrawn or incorporated into another identity or logo

• may not be transferred or supplied for use by another person or organisation

• may not be used in a way that suggests employment by, partnership with, certification by, or endorsement from Thisness

• may only be used while the corresponding Practitioner Membership remains active

Practitioner identity indicates an active licence to practise Thisness. It does not represent accreditation or certification of an individual's professional competence.

Independent Practitioners

The Thisness methodology may be used by independent practitioners in their own professional work.

These practitioners operate independently and are not employees, agents, or representatives of Thisness or Rob Hotchkiss.

Thisness does not provide services through third-party practitioners and is not responsible for the work, advice, or outcomes delivered by individuals applying the methodology.

Any agreement, contract, or engagement entered into with a practitioner is solely between the practitioner and their client.

Discipline Use

The Thisness Toolkit introduces a structured discipline for exploring brand clarity and creative direction. The discipline itself, including its structure, organisation, named concepts, frameworks, diagrams, and written explanations, remains the intellectual property of Rob Hotchkiss / Thisness.

Practitioner Membership grants permission to apply the ideas and tools within your own professional work.

You may not:

• reproduce or publish the discipline as your own framework

• create derivative toolkits or training materials based substantially on the toolkit

• teach, license, or distribute the discipline as a standalone system without permission

• reproduce the toolkit diagrams, frameworks, or written structure in full or substantial part

Acceptable Use

You agree not to use this website:

• for unlawful purposes

• to attempt unauthorised access to the website or its systems

• to interfere with the operation or security of the website

• to introduce malicious software or code

Refunds

Practitioner Membership includes immediate access to digital resources, including the Thisness Toolkit and Practice Sheets.

Thisness offers a 14-day refund period from the date of your original purchase. If you are not satisfied with the practitioner resources during this period, you may request a refund by contacting: rob@hot-creative.co.uk

Refund requests under this policy must be made within 14 days of the original purchase date and will be processed through Lemon Squeezy.

Because Practitioner Membership includes digital content supplied immediately after purchase, statutory cancellation rights relating to digital content may be affected once access to that content begins. Where required by law, you will be asked to consent to immediate access and acknowledge the effect this has on your statutory right to cancel.

The 14-day refund period offered by Thisness is provided in addition to your statutory rights.

After the 14-day refund period has passed, payments are generally non-refundable except where required by applicable law.

Cancelling a Practitioner Membership prevents future renewal but does not normally generate a refund for the current membership period.

Nothing in this refund policy affects your statutory rights.
